Statement on modalities of further work at the first formal meeting of all States on the implementation of Resolution 1 adopted at the 32nd International Conference of the Red Cross and Red Crescent on “Strengthening IHL Protecting Persons Deprived of Their Liberty”

I would also like to extend our gratitude on behalf of Estonia to ICRC for convening this meeting and for the extensive preparatory work.

 

Estonia recognises the important work done by the ICRC in facilitating these discussions, in order to ensure a state-led, collaborative, non-politicised, inclusive and transparent further work to strengthen IHL in protecting persons deprived of their liberty. It is of deep concern that persons deprived of their liberty in relation to armed conflict are often vulnerable, including to inhumane treatment.

 

Estonia expresses its general support to the proposals provided by the ICRC on the modalities, facilitation and work plan of the current process.

 

Estonia emphasises the importance of having States involved in facilitating this process. The need for greater involvement of States was one of the main lessons learned of the last period. With regards to the model of facilitation, Estonia therefore supports the proposed co-facilitation of the process by Australia and Columbia together with the ICRC – a co-facilitation that would be performed based on the modalities to be agreed by the states.

 

Having two state-co-facilitators would allow states being involved and also states leading this intergovernmental work, which aims to ensure that international humanitarian law remains practical and relevant in providing legal protection to all persons deprived of their liberty in relation to armed conflict.
